Defending the Future (Ages 16 and Under)
Every young person deserves a second chance. We fight to protect their future through rehabilitation-focused defense and advocacy.
In Georgia, the juvenile justice system handles cases involving youth under the age of 17. Unlike the adult criminal justice system, the juvenile system is designed with a focus on rehabilitation rather than punishment. The goal is to help young people learn from their mistakes and become productive members of society, rather than being defined by the errors of their youth.
However, the juvenile justice system is not always lenient. In serious cases, juveniles can be tried as adults, facing the same penalties as adult offenders. Under Georgia law, juveniles can be tried as adults for certain Class A and Class B felonies, including murder, armed robbery, and rape. The minimum age for being tried as an adult is 13 years old.
At Windecher Firm, we are dedicated to protecting the rights and futures of young people in the justice system. Our juvenile defense attorneys understand the unique challenges and opportunities of the juvenile court system, and we work tirelessly to ensure that every young person we represent receives fair treatment and the best chance at a bright future.
Juvenile cases require a fundamentally different approach than adult criminal defense. Our attorneys understand the unique procedures, rights, and opportunities within the juvenile justice system. We work closely with families to build strong defense strategies that account for the young person's background, circumstances, and potential for growth. From initial detention hearings to adjudication, we advocate fiercely for the best possible outcome.
We strongly advocate for alternative sentencing options that prioritize rehabilitation over punishment. This includes community service, counseling programs, educational interventions, mentoring programs, and restorative justice approaches. Our goal is to help young people learn from their mistakes without being burdened by the long-term consequences of incarceration or a permanent record.
Georgia offers several diversion programs designed to redirect juveniles away from the formal justice system. These programs provide supervision, counseling, and support while avoiding the stigma and consequences of a formal adjudication. Our attorneys know which programs are available in each jurisdiction and advocate aggressively for our clients' participation in these programs.
When probation is the outcome, we work to ensure that the terms are fair, manageable, and focused on rehabilitation. We advocate for conditions that support the young person's education, family relationships, and personal development. If probation violations occur, we represent juveniles in violation hearings, fighting to prevent detention and maintain community-based supervision.
Parents trust Windecher Firm to protect their children's futures.
